Terms of Use
The rules for using Captive Studio, for everyone who signs in to it.
Effective November 2, 2026 · Version 2026-11-02
1. What these terms are
These terms are an agreement between you and Airwalk Properties LLC, a Tennessee limited liability company doing business as Captive Demand ("Captive", "we", "us"), for your use of Captive Studio, the portal through which Captive's clients edit, publish, and run the websites Captive built for them. By signing in to or using Captive Studio, you accept these terms.
If you use Studio on behalf of a business or other organization, you accept these terms for that organization too, and "you" includes it.
2. How these terms relate to your subscription
Each client organization also agrees to the Captive Studio subscription terms when it claims its site. Those terms set the fees, the minimum term, cancellation, what the subscription includes, and how additional work is quoted and billed. An organization can read the version it accepted from the Billing page.
If these terms and the subscription terms conflict, the subscription terms win. Any separate written agreement between your organization and Captive for marketing or other services also continues to apply.
3. Who may use Captive Studio
Captive Studio is for Captive's clients and the people they invite. You must be at least 18 and able to enter into a binding agreement, and you may use Studio only for the organizations you have been invited to.
4. Accounts and organizations
You need an account to use Studio. Give accurate information, keep your sign-in details to yourself, and tell us promptly at support@captivedemand.com if you think someone else has used your account. You are responsible for what happens under your account.
Sites belong to organizations. Anyone an organization invites can edit and publish its sites, and the organization is responsible for who it invites and for removing people who should no longer have access.
Captive staff can access your organization in Studio to provide support, maintain your site, and keep the service secure.
5. Acceptable use
When using Captive Studio, do not:
- publish or upload anything unlawful, defamatory, fraudulent, or that infringes someone else's rights, including copyright, trademark, and privacy;
- publish health, pricing, or other claims about your business that are false or misleading;
- upload malware or try to break, probe, or overload Studio, its security, or the sites it runs;
- try to reach organizations, sites, or data you have not been given access to;
- use the AI editor to produce harmful or prohibited content, or to get around its limits;
- resell, sublicense, or share access to Studio outside your organization, or copy it to build a competing product;
- use automated tools to access Studio, other than the features it provides.
We may limit request rates, remove content, or pause access where we reasonably need to in order to protect Studio, our clients, or the public (section 11).
6. Your content
Your content stays yours. That includes the text, images, products, and other material you or your team add to Studio, and your brand and domain name.
You give Captive a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt (for example resizing images or formatting text), display, and publish your content, and to send it to our service providers, as needed to run Captive Studio and your site and to support you. The licence ends when your content is deleted from Studio, except for copies kept in backups and records for a limited period.
You confirm that you have the rights needed to give us that licence, and that publishing your content will not break the law or anyone's rights.
If your site has a shop, you are responsible for your products, prices, taxes, shipping, returns, and your dealings with your customers.
7. AI-generated suggestions
The AI editor and the automatic image descriptions use an AI provider to suggest text, edits, alt text, and tags. Suggestions can be inaccurate, incomplete, or unsuitable, and similar suggestions may be given to others.
AI edits are saved as drafts. You are responsible for reviewing them before you publish. Captive is not responsible for content you publish, whether you wrote it, edited it, or accepted it from an AI suggestion.
AI usage counts against the allowance described in your subscription terms. The Privacy Policy explains what is sent to the AI provider.
8. Captive Studio is ours
Captive Studio, its software, the site platform, templates, and the code and design Captive created are owned by Captive or its licensors. While your organization's subscription is active, you may use them for your organization's sites as these terms and the subscription terms allow. No other rights are granted.
If you send us ideas or feedback, we may use them without any obligation to you.
9. Services from others
Studio relies on other companies' services, such as sign-in, payments, hosting, media delivery, email, and AI. Your site may also use services you choose, such as a payment account for your shop. Your use of those services may be subject to their own terms, and we are not responsible for services we do not control.
10. Availability and changes to Studio
We work to keep Captive Studio available and your site online, but Studio may be unavailable at times, for example during maintenance or because of problems with services we rely on.
We improve Studio over time and may add, change, or remove features. We will not remove a feature your subscription terms promise without telling you first.
11. Suspension and termination
We may suspend or end your access to Studio if you break these terms, if your organization's subscription ends or payment fails as the subscription terms describe, or if we must to comply with the law or to protect Studio, our clients, or the public. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
An organization can remove you, and you can stop using Studio at any time. Ending your organization's subscription is covered by the subscription terms, including what happens to your site and how to get an export of your content.
Sections 6 (the licence for copies we keep), 8, 12, 13, 14, 15, and 16 continue to apply after your access ends.
12. Disclaimers
Except as your subscription terms expressly promise, and to the extent the law allows, Captive Studio is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Studio will be uninterrupted or error-free, or that AI suggestions will be accurate.
13. Limitation of liability
To the extent the law allows, Captive is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of Captive Studio, even if we were told they were possible.
Our total liability arising from these terms or your use of Studio is limited to the subscription fees your organization paid Captive in the 12 months before the claim arose. Nothing in these terms limits liability that the law does not allow to be limited.
14. Indemnity
You will defend and indemnify Captive against claims, losses, and costs (including reasonable legal fees) that arise from your content, your use of Studio in breach of these terms, or your shop and your dealings with your customers.
15. Changes to these terms
We may update these terms. We will change the effective date at the top, and for a material change we will tell you by email or in Captive Studio at least 30 days before it takes effect. Using Studio after a change takes effect means you accept it.
This is version 2026-11-02 of these terms.
16. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute arising from these terms or your use of Captive Studio will be brought only in the state or federal courts located in Davidson County, Tennessee, and you and Captive consent to the jurisdiction of those courts.
